better business bureau and since you are in cali there must be a lemon law given you constantly had to bring it in.
ok, so suing him, you can't squeeze money from a turnip, but at least get a judgement / lean, so that if he does sleaze money from another source, you got an earmark on it.

Lightning Motorcycles

So,
- Multiple near-death experiences.
- $4700 for "repairs" due to a bike failure that put you on the ground.
- $8000 for a "free" battery upgrade to a SMALLER capacity.
- NO warranty whatsoever on battery or related labor.
- 38 hours of "testing" in which you are likely paying for R&D.

I presume they are keeping the bike hostage as well, preventing multiple dealer visits to thwart the Lemon Law? How much did you pay for this thing?

And that's what they do to a patient, excited customer who went out on a limb for them.

I should have included the latest bill, which is unpaid.
Please review and tell me your thoughts.
BTW:  Currently, I owe LM. $51,381.00.
       This is after I paid $27K for the bike.

This story would make for a wonderful TV station consumer problem investigation. The San Francisco ABC network station Channel 7, loves to dig into issues like this and they have a fellow on their staff that really knows how to ask questions and dig into issues, that will not only drive the scammer crazy but will also make for great TV news theater.  ;)  Plus, they know which state government buttons to push, such as at the DMV and the State Attorney General, and they usually get results. Not only that, but it doesn't require you to take the time and expense to sue Lightning in Superior Court.  :)  I think contacting the station and telling your story should be worth doing.

And if that doesn't work you could write a book.   ;)

I would even go so far as to delete this EMF thread, or at least your unflattering posts in it if you are subject to an NDA. As much as we love the validation of our suspicions of Hatfield and company, it would suck to win a judgement for being scammed but losing separately for clear violation of non-disclosure terms.

I mean there's more than just you (probably) but we don't hear about it because of, what I suspect are, NDAs. It would add the complexity to your case that you would need to prove the NDAs were intended to cover the scam and silence victims.

Sorry to hear about this… I was really hoping that things had worked out for you.

I spoke with Richard in person about your case last summer - I was in Hollister getting a new seat on my Energica - wandered back to the LM shop.
I asked him what happened to Apollo’s bike - he answered, “It was just a bad cell in the battery pack”. Like it was no big deal - easy to fix, end of story.

Please review the bill, try to understand the work done, and the charges.
Ho-lee shit. That's just about the silliest invoice I've ever seen, comical even. If I saw that and didn't know better I would assume it's either a joke, made up hours from a child who has no idea what they're doing, or some sort of "we do this to follow procedure and keep track of hours but you won't actually be charged for it" kinda thing. While I'm glad they're thorough it doesn't take 4 hours to inspect a bike and find those repairs. And testing after repairs is part of the repair procedure, and for the work that was carried out 14 hours is ridiculous. Hell if they built a whole bike from scratch it doesn't even take that long to test. Even one hour for that testing carried out would be generous.

As for the battery, ignoring the fact they said it would be a free replacement, are those 42 hours spot welding hundreds of 18650s by hand (I know that's not what they use, just trying to rationalise)? No it can't be, even that wouldn't take that long. Are they including the time to mine the ore, process it, and assemble each cell? And for the 24 hours to test it I assume they assembled the pack with empty cells and had to wait for them to charge, fully discharge it, and then recharge it. Multiple times.

or maybe their stock sale scam didn't pan out as well as they hoped it would and they still want that vay cay, so might as well try to schlep apollo, afterall he foolishly bought their product to begin with, maybe he'll bite again.
