That's exactly the same thing I've just found too. And I agree with your conclusion. This is definitely makes the top 100 of the dumbest
things our Congress has ever done.

I will do some research to find out who authored that tax extension, and will contact their office for clarification. Ridiculous.

Another explanation. Looks pretty clear that we're being punished for the sin of buying our bike in 2014. Fuck everyone who bought electric bikes that year in particular.

needed to have a battery capacity of at least 2.5 kilowatt-hours, be manufactured primarily for
use on public streets, roads, and highways, and be capable of achieving speeds of at least 45
miles per hours. The maximum credit for any qualifying vehicle was $2,500.

Explanation of Provision
The provision reauthorizes the credit for electric motorcycles acquired in 2015 and 2016
(but not 2014). The credit for electric three-wheeled vehicles is not extended.
Effective Date
The provision is effective for vehicles acquired after December 31, 2014.

It appears the years were coded like that in the very original bill, even prior to any changes :

(b) Effective Date.—The amendments made by this section shall apply to vehicles acquired after December 31, 2014.

If it is to act as a intensive to buy a EV, then why would it be retroactive.  None of us bought our Zeros on a promise from a politician that the tax credit would be back.  If the credit applies to you, then it should be just icing on the cake.  It will lower the prices of used bikes, which helps you if you are a buyer. 

If you really want to take advantage of tax law, start your own business and be aggressive.  There is a lot more than $2000 in intensives out there.

Technically Zero used it part of their marketing messaging. They said even though the credit expired in 2013, they're actively lobbying
to have it renewed. Another angle to consider, the law that just passed affects purchases made PRIOR to its passage, but creates three
classes of citizens :

those who purchase prior to passage in 2015, eligible for the credits
those who purchased prior to passage in 2013, still eligible for credits
those who purchased prior to passage in 2014, ineligible for credits

I've just tried to contact that representative, but it gave me an error that I am not in his district and can't talk to him... I will try to
proxy through my rep here in Oregon.

For other tax credits congress simply extended the termination date.  For example, The "Alternative Vehicle Refueling Property Credit" expired Dec 31, 2014 and they just deleted that and changed the date to Dec 31, 2016.  The "New qualified plug-in electric drive motor vehicles credit" which also included 2 and 3 wheeled vehicles expired Jan 1, 2014 but instead just deleting that and extending it to Dec 31. 2016 or Jan 1, 2017 they left out those who purchased in 2014.  Those are sections 182 and 183 respectively...literally right next to each other in the bill and congress jacks it up.

When I purchased my bike in August of 2014 the dealer used the fact that the "New qualified plug-in electric drive motor vehicles credit" was supposed to get extended as a selling point.  I was going to buy anyway but I thought I was going to get the credit making the purchase a little cheaper.  Of course, at the end of 2014 congress renews a credit for 4 wheel vehicles but leaves out those on 2 or 3.  Then in 2015 they retroactively give the credit to those on 2 or 3 wheels that bought in 2015 but leave those who bought in 2014 out in the cold.

This isn't about taking advantage of tax law.  Its about promoting cleaner alternatives for transportation and rewarding those that take the plunge early.  Not surprisingly, our elected officials failed us once again.

If you bought it in 2015, then you would likely file it this year (2015 taxes), even if it's a 2016 model.

I'll put it down as a misc. form and hope I don't get audited.

I purchased my '14 SR in 2014 expecting the credit (not knowing it had expired). I talked with the salesman at the dealership and he printed out the tax credit eligibility form, that iirc, stated I was eligible.
I gave the information to our accountant and he later told me that the tax break had expired.

So, just for clarity here, amendment of the '14 tax return for a Zero purchased in '14, will actually work and I should get the refund that partially incentivized me to buy in the first place?

No, I don't believe that would work.

P.S. I've contacted my House Rep over 3 weeks ago, no reply so far.
