I think if I read it correctly the vehicle needs to have at least 4 wheels .... no?

Q1. What is a new clean vehicle for purposes of the new clean vehicle credit? (updated February 3, 2023)
A1. For purposes of the new clean vehicle credit, a new clean vehicle is a clean vehicle placed in service on or after January 1, 2023,
that is acquired by a taxpayer for original use. In addition, to qualify for the credit, the vehicle:
• Cannot be acquired for resale;
• Must be manufactured by a qualified manufacturer;
• Must meet the definition of a motor vehicle under Title II of the Clean Air Act (that is, any vehicle manufactured primarily
for use on public streets, roads, and highways. It must also have at least four wheels);
• Must have a gross vehicle weight rating of less than 14,000 pounds;
• Must be powered to a significant extent by an electric motor with a battery capacity of 7 kilowatt hours or more and must
be capable of being recharged from an external source of electricity; and
• Must have final assembly in North America.
Moreover, for a taxpayer to claim the credit, the seller of a new clean vehicle must provide a report containing taxpayer and vehicle
information to the taxpayer and to the IRS. See Topic B FAQs 7-9 for additional detail.
Fuel cell vehicles are also new clean vehicles if (1) the original use begins with the taxpayer, (2) the final assembly is in North America,
and (3) the seller of the vehicle provides a report to the taxpayer and the IRS.

For the NEW law, ahh, yah it does look that way, they don't have the Energica listed.  BUT, I think if they do the paperwork, and since the thing is assembled in Caly for the final part, it should qualify for being built in the US.

I am not sure what all has to be done on the manu's side to get added to the list of approved vehicles.  I'll ask my accountant to look into that, but honestly think Energica CAN get qualified for that.  Even if it's only the 3750 credit, thats a hell of a lot more than the 2500 dollar cap under the old program for the bike.

The biggest problem is the IRS just totally FKN sucks donkey balls. You literally can not get anyone on the phone it will flat out tell you, we are too busy to answer phones, try another time and hang up on you.  I will see what I can find out as to what it takes to get on their list.  Id really like to get some cash back on my bike!

When they (the federal government)  are talking about final assembly they aren't referring to where the windscreen, mirrors and luggage are attached.

the "final assembly" location is where all the supply chains converge. The cells, the pack, the fairings, the bolts, the wheels, tires, bearings and frame parts. It's which country gets to put that product's sales numbers on their count sheet for GDP. Energicas definitely have final assembly in Italy.

It's a much bigger hurdle than the semantics would indicate. There are corporate incentives for having final assembly in the US. That's why Subaru, BMW, and other foreign manufacturers have production facilities in the US. All overseas marques have bikes that arrive in crates to be put together when they get to the dealer. if that was considered "final Assembly" the big four would be all over it.

Plus, Zero and Livewire don't qualify for the tax credit...they do have final assembly in the US.

VIN #40..!!?? Or is it #140..??  I believe they're up into the mid 100's now....Mine is #029 and I got mine back in mid February. There was a chap on the bookface group who had not long ago taken delivery of VIN #120.

Im pretty sure that is the proper VIN for your bike.  The dealer should have looked when he gave you the title what the VIN was!  Well unless it was the Florida one then who knows...

The bikes are not always going to arrive in sequential number.  Arrival /Customs in Commiefornia may take 3 months just to get it into the dock.  In Florida, a week or so then another week to ship it to ComFo for the final assembly.   Yours could have been shipped and they were waiting for centerstands, as an example of a part, and the finishing thing just NOW got in, but others shipped later, had all their stuff, so went out sooner.   1001 things than would doink up a FIFO.

BTW, the Bay Area news is reporting that the port of Oakland, CA, is having work disruptions again as the workers have been without a contract for the past year and are unhappy about the situation. So Energica's idea of switching their U.S. off-loading port to the East Coast continues to look like a smart move.

If they were really smart, they'd move their manufacturing / final assembly to Florida as well.  A lot cheaper to live, a LOT more friendlier to business', several ports literally within a few hours of each other.  They could move to Jacksonville, run out of JaxPort, and have a Depot level shop here too.  That'd also give me a local shop to do my Energica business with too!  Plenty of warehouses going up ALL over (which honestly I am not too happy about but it is what it is).  With the economy going in the shitter, I am betting they could get a nice deal on the rent too among other enticements from Local / State entities as well.

Set up a few acres of solar panels, and run the electric bike and its shop on solar.  Yes yes I know but the PR would look real snazzy !!
TBH it's another of my nerd projects but I have a few rows of panels sitting on my driveway I plug the bike into to charge off of....just to say it's 100 percent sun powered and to say that yep I did it ! :D
