Indian thinking about an electric motorcycle
« on: June 11, 2020, 03:42:49 AM »

I guess Harley's LiveWire has spurred Polaris's Indian brand to think about marketing another electric motorcycle some time in the future.  But I won't be holding my breath until it shows up: https://www.motorcycle.com/manufacturer/indian/indian-files-eftr-trademark-for-an-electric-motorcycle.html

It wouldn't surprise me if they're just doing it (getting the trademark) to protect the FTR because EFTR would probably be a logical choice for any other company that comes up with an electric flat tracker. Also if actual electric flat track races ever become a thing the trademark might have some value.

Well, it is true that trademarks are less expensive than actually designing, manufacturing and marketing an entirely new vehicle.  ;)

Trademarks are supposed to require an actual product, but that is rarely held up in court.

See also Ford 'Model E'.

Are you sure you're not thinking of a patent? You can trademark a name or logo without an underlying product.

It's supposed to have one.

Trademarks are supposed to have an underlying product; you can't just sit on names with no reasonable expectation you'll put out the product.

You don't need a product or a path to make it for a patent.

I think you will admit that just about every company has tried to trademark just about every word in the English (and likely other) language at one time or another.  Right now the U.S. Supreme Court is considering if adding the words "dot com" to a common dictionary word that is used every day can be trademarked. One trademark that didn't fly in court was when H-D tried to trademark their V-twin "potato, potato" exhaust noise.  So apparently there are limits.   ;)  (Who knew.   ::) )

Well, a dot com is a product ^-^

Trademarks also are supposed to only apply to their commercial market segment.
