MVetter, It may depend on what regen setting you have selected on the Energica. I have mine set on high and when I tested it I am positive the brake light stayed on.
Perhaps it is different on different model years.

BTW, how did  you test for it?

BTW, I have one of these on my main helmet and I wish it would beep or something when the brake light is lit.

Don,

I went out on a long straight road with little traffic at night. Discovered that if you looked at the road directly below the bike the road would be lightly illuminated when you hit the brakes and the brake lights came on. So I got up to about 30-40 mph and then cut the throttle and you could see the same illumination from regen as when you hit the brakes.
